Congratulations to Robert Lynch

Attorney Robert Lynch recently defended Lynch, Traub, Keefe & Errante clients, Colleen King and Cecil King, against the claims of an adult child who believed that he was entitled to the ownership of their home after their deaths based on an oral agreement which involved work he performed in constructing their home. The plaintiff asked the court to impose a resulting trust on the home or, in the alternative, award monetary damages that exceeded $250,000.00 for labor and money he claims that he provided for their benefit. The trial court held that the plaintiff failed to prove the existence of an enforceable oral agreement and failed to prove that the defendants were unjustly enriched by the plaintiff’s work. The trial court also found that the plaintiff failed to prove that he provided the labor and money that he claimed.

On appeal, the Appellate Court upheld all of the rulings of the trial court. The Appellate Court found that the findings of the trial court were well supported by the evidence and that the legal conclusions of the trial court were correct. The case is reported as “Stewart v. King,” 121 Conn. App. 64. (2010).
